9. Rights Regarding Automated Decision-Making (Article 22)
Automated Decision-Making Disclosure: The CFIN software uses automated algorithmic decision-making to execute trades on your MT5 account when authorised by you. This section explains how it works and your rights.
Nature of Automated Processing: The CFIN trading software (Expert Advisor) automatically analyses market data and executes trades on your account without human intervention, when authorised by you, the licensee. Specifically:
- What the software does: The software analyses price patterns, volatility, and market structure to identify potential trade setups, then automatically opens and closes positions on your MT5 account
- Logic involved: The software uses proprietary technical analysis rules including breakout patterns, momentum indicators, and risk management formulas to determine trade entries, exits, position sizes, and stop-loss/take-profit levels
- Significance and consequences: These automated decisions directly affect your financial position. Trades executed by the software may result in profits or losses on your trading account. The software operates continuously during market hours and may execute multiple trades per day
- Risk management: Each trade includes predefined risk parameters (stop-loss, position sizing limits, drawdown budgets) designed to limit but not eliminate potential losses
Your Rights and Control:
- You may request human review of any trading decision or pattern by contacting support@cfin.be
- You may express your point of view and contest any automated decision
- You retain full and ultimate control of your broker account and may revoke the software's access at any time by changing your MT5 credentials or contacting your broker
- You may cancel your software license at any time to stop all automated trading
- You, not CFIN, authorise the software to operate — this authorisation is revocable by you at any time
Legal Basis: Automated trade execution is performed on the basis of contractual necessity (GDPR Article 6(1)(b)) — it is the core function of the software you licensed. Your explicit consent and authorisation for automated trading is obtained during registration.
